The short version

This summary is for convenience. The full terms below are what apply.

1. Who we are and what these terms cover

mobiledetailing.app is operated by [COMPANY LEGAL NAME] (“we”, “us”). These terms apply when you create an account, use our website, booking pages, field app, AI features or any other part of the service (together, the “Service”). By creating an account or using the Service, you agree to these terms. If you use the Service for a business, you confirm you can agree on that business’s behalf.

2. Your account

You need to give accurate information when you sign up and keep it up to date. Keep your login details private; you’re responsible for activity on your account, including by staff you add. Tell us right away at info@mobiledetailing.app if you think someone has accessed your account without permission. You must be at least 18 to use the Service.

3. Plans, billing and cancellation

4. Payments from your customers

Deposits, invoices, tips and gift cards are processed by a third-party payment processor (currently Stripe) under your own account with that processor. Their terms apply to those payments. Payments go to you, not to us, and you’re responsible for refunds, chargebacks and disputes with your customers, and for any processor fees.

5. Your data and your customers’ data

You keep ownership of everything you put into the Service, including your services, prices, photos and your customers’ details (“Your Data”). You give us permission to store, process and display Your Data only as needed to run, secure and improve the Service for you. We handle personal information as described in our Privacy Policy. You’re responsible for having a lawful basis to collect your customers’ information and for telling them how you use it. You can export or ask us to delete Your Data; some records may be kept where the law or payment processors require it.

6. Texting, calls and email

You may only send texts, emails and calls through the Service to people who have agreed to hear from you, and you must follow the laws and carrier rules that apply, including the TCPA, CAN-SPAM and A2P 10DLC registration requirements. Honor opt-out requests such as “STOP”. Business phone numbers are provided through carrier partners; we can’t guarantee a particular number or that every message is delivered. Call recording features must be used in line with recording-consent laws in your area and your customers’ area.

7. AI features

The AI website chat, AI phone receptionist and other AI features answer customers using the information you give them. They can make mistakes or misunderstand a request. You’re responsible for keeping your services, prices and availability up to date, and for reviewing bookings and quotes the AI makes. Don’t rely on AI features for emergencies or legal, medical or safety advice.

8. Websites, booking pages and domains

If we build or host a website or booking page for you, you’re responsible for the content you provide, including having the rights to any photos, logos and text. If you connect your own domain, you keep ownership of it. Search rankings, traffic and bookings depend on many things outside our control, so we can’t promise particular results.

9. Acceptable use

Don’t use the Service to break the law, send spam, harass anyone, upload malicious code, infringe someone else’s rights, try to access other accounts or our systems without permission, or resell the Service without our written agreement. We may suspend accounts that put other users, carriers or the Service at risk.

10. Our software

We own the Service and its software, design and content (other than Your Data). We give you a limited, non-transferable right to use it while your account is active. Feedback you send us may be used to improve the Service without obligation to you.

11. Third-party services

The Service connects with other companies’ products, such as payment processors, bank-connection providers, phone carriers, Google and email providers. Their terms and privacy policies apply to your use of them, and we aren’t responsible for their availability or actions.

12. Ending your account

You can close your account at any time. We may suspend or close an account that breaks these terms, isn’t paid, or creates legal or security risk; where reasonable, we’ll tell you first and give you a chance to fix the problem and export Your Data.

13. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Service will be uninterrupted or error-free, or that it will produce any particular number of bookings or amount of revenue.

14. Limits on liability

To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, bookings or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if you’re on the free plan.

15. Indemnity

You agree to cover our reasonable costs, including legal fees, if a third party makes a claim against us because of Your Data, the messages you send, your services to your customers, or your breach of these terms.

16. Changes to these terms

We may update these terms as the Service changes. We’ll post the new version here with a new effective date, and for significant changes we’ll notify you by email or in the app at least 30 days before they apply. Continuing to use the Service after that means you accept the updated terms.

17. Governing law and disputes

These terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [COUNTY] County, [STATE], unless the law requires otherwise. Before filing a claim, please contact us so we can try to resolve it informally.
